The Department of Financial Services issued the following Circular Letter (CL) to insurers authorized to write policies in New York State.
April 21, 2022 – Insurance Circular Letter No. 6 (2022) – Coverage of Early Intervention Program Services
• The purpose of CL No. 6 is to provide guidance to insurers authorized to write accident and health insurance in New York State relating to the changes to the Early Intervention Program (“EIP”) in relation to comprehensive health insurance coverage, pursuant to Chapter 820 of the Laws of 2021. As of January 1, 2022, health insurers are no longer required to reimburse EIP services provided pursuant to Public Health Law Article 25, Title 2-A on and after January 1, 2022.
• Claims for EIP services provided prior to January 1, 2022 and otherwise covered under a policy or contract, should be processed accordingly.
• For the period of January 1, 2022 through March 22, 2022, insurers may have received claims for EIP services, but they are not responsible for reimbursing such claims for EIP services, provided the date of such services was on and after January 1, 2022.
